Accused of being a John Doe in a motor vehicle accident?
Q: I'm being listed as a possible john doe in a motor vehicle accident that happened in 2006. I was residing in a different province and attending trade school at the time. I have the documentation to support this. A private investigator contacted me and i told him that i wasn`t involved, and he still suggested to his client that i should be listed as the john doe in this case. Because i told him i had nothing to do with it, he took that as an admission of guilt some how. now im being sued and i was served papers on the 14th. is there any way that i can resolve this issue without having to pay a lawyer. can i submit my papers that show my whereabouts on this day to duty counsel. If i end up having to pay for a lawyer can i sue the investigator for harassment, since i told him i had nothing to do with it, and he still listed me as the john doe. and at the same time who can i sue for lost wages and lawyer fees.I`ve made attempts to contact the lawyers and investigator to se if i can supply them with my documents and clear my name, but that has gotten me no where. what should i do.....the papers provided to us only state the information collected by the investigator, and how he came about the information. what happened was that after the accident a person called in to say that they had witnessed the accident. the person identified themselves as "nick". from there they traced a number to a vanessa, they then found that vanessa had a friend named nick ***** based on that information he contacted me, and when contacted i told him i knew nothing of the incident and wasn't in the province at the time. he still felt like i was the person and suggested to his clients that i should be listed as the john doe. no further questions have been asked of me and no further contact from anyone has been attempted. aside from the papers being delivered.Also at the time of the incident i wasn't insured. but was using my dads vehicle. the lawyer for the plantiff suggested i contact my dads insurance company and have them do the foot work and go throught their lawyers is this what i should do?
A: The papers should specify the attorney handling the matter. Make a copy of all relevant documentation and send it to them with a letter specifying that you were not at that location and request you immediately be dropped from the case. Send this certified mail, return receipt requested.If that doesn't work you may have to appear in court, at which time you can request the matter be dropped based on your evidence that you previously provided to the attorney, and also request sanctions.I'm not surprised the investigator did not drop the matter, they rarely take people's word for it and don't always get paid if they don't finger someone. The attorney will hopefully be more diligent.Don't involve the insurance company until as a last resort. Since you were not actually involved in the accident, your dad's company has no standing in the matter and it may affect his rates.
