Q: Hi,I went to a local bar on Saturday to have a few drinks. As it got late (around midnight) there were several very intoxicated patrons in the bar making threats near me. One of the guys came to me & asked if I knew the guy beside me. I never been to that place in my life & did not know anyone in the area. I told the doorman what was going on & they were threatening to practically kill each other, using racial slurs etc. The doorman said he would check into what was going on but the whole event escalated into an all bar fury. One group was looking at me because I tried to keep the peace & avoid conflict with any group. It was my first time at that bar & did not know anyone there. I was alone & seeing it was against a group of people decided to call 911.The police arrived between 5-10 minutes. They searched the bar but the culprits were gone. They advised me that they probably were intoxicated & told me that its probably just verbal threats, nothing more. I told them I was leaving & that I lived close to the establishment they said ok & "be careful". When I was walking home I had a feeling I was being followed. I did not go straight home worrying they would know my address. I went into a pool hall in close proximity & then a few guys from that group came in & were looking at me aggressively. I told the people working there that these people appear to be out to get me. I once again called 911 again & the police this time arrived & arrested me on the spot. All this time the culprits were in the bar. The police took me outside & said I was intoxicated & disturbing the peace, they did not read me my rights. I did have a few beers but was not overly intoxicated. As they put me in the car a huge brawl erupted between the police & the people I alleged were causing mayhem that night. I told the woman police driver that those were the people & she told me to "shit the F up" that is was my fault all that happened. She asked me if I drove there that night I said "no, I live about 2 mins from here"... She saw on my report that i had a DUI when I was 19 (about 16 years ago) no priors. She asked where was my car & she was going to try & get me on a DUI again... That's the beginning of this nightmare.After being shoved in the car the handcuffs were so tight I had no circulation in my hands. I pleaded with the lady to loosen them before the blood flow completely stopped in my hands. She laughed & said stop complaining. I pulled my hands around my legs & put my hands in front of me. She saw that my hands were in front & really started to get crazy. She I am going to f'ing get you tonight you SOB. We left in the car with her driving & her male partner. They drove in back of a building where all the cops were gathered after the event & they said "your bringing him to jail?" She said yes this f'cker is going down tonight... They all laughed.On our way to the station I kept trying to tell her what happened & she said she did not care & to shut up. She slammed on the breaks & my head hit the plexi-glass divider giving me a black eye & a scratch to my face. She said are you done or I will do it again. Her partner told her to calm down. She then blasted the music in the car extremely loud for about 5 mins... I then told myself not to reason with these people anymore.To make this long story short. I spent one night at the police station. I could not call my gf to tell them what happened. She took my phone before I got into the car. Once at the station they told me if I want to call a lawyer I could. I said I don't know of any lawyers & asked what do I do? They said forget it & placed me in a cell. One of the arresting officers came to see me a few hours later to see how I was. I told him that I was unjustly arrested, harassed, ridiculed & just wanted to go home. He told me he had to do paperwork on my case & then I could go. They released me after a few hours & gave me 2 fines. 1- Calling 911 for no reason (they did stop the people that were causing all that trouble that night.)2- Being intoxicated in a public placeThe next day I talked to a Sargent who told me that the events of that night was not standard practice. He said he would look into it, yeah right.I decided to make a deposition to the internal affairs unit. This happened in Canada not in the US. This is the truth of what happened that night without any exaggerations.Sorry about the long story but it was a long night...Anyone out there with any opinions?Thanks in advance.
A: Get a good EXPENSIVE lawyer, the more money he/she charges, the better. Plead not guilty to the 2 summons. Ask for a jury trial. You will win. That's just the beginning. Now, armed with the trial by jury not guilty verdict, sue the police department that arrested you. You will win and make plenty money. Do it. The lawyer's fee? He'll be glad to take a portion of your settlement $. Good Luck.
