Q: Assume you get pulled over for something and the officer suspects that you're drunk and you aren't. What protection do you have against the undeniably biased field sobriety tests? I'm not referring to the set of 3 that the NHTSA has suggested be used, but the ones that are designed to be failed.Can you refuse to take the non-standardized tests and take the standardized ones? Will this still result in arrest? If so, what for? Implied consent violation or DUI/DWI?If you are able to pass the standardized tests, but fail one or more of the non-standardized tests what happens? Can he arrest you because you couldn't complete one of the tests properly? If so, is this on probable cause that you were intoxicated? What happens when/if you get to the station, submit a blood sample, and when the results come back you didn't have alcohol in your system? What punishment is involved for this officer? If none, then what's to stop officers from pulling over everyone that "appears" to be intoxicatedand conducting a field sobriety test? All they would have to do to cover their own butt is throw around "probable cause."If you failed the field sobriety test but your BAC is 0%, or some other very minuscule amount, are you still guilty of driving under the influence? What will happen to you? Will you be let go or will they say you were still too impaired to drive and thus guilty of a crime? If they decide to issue a drug test and the test returns that you have used marijuana recently, how can they prove that you were using it WHEN you were pulled over?Are the non-standardized tests admissible in court? If so, how are they credible at all?When you get back to the station can you refuse to take the breath test and take the blood test instead? The blood test is more definitive and breathalyzers have been known to read amounts far from the actual amount.If you do get arrested for DUI, does that give the officer consent to search your car for illegal substances?
A: I only use the Standardized Field Sobriety tests. You can refuse to take any and all tests roadside, but I can and have still made cases for DWI based solely on my observations of drivers absent any tests at all.You do not have the right to choose your own chemical test. If I offer you a Breath test, and you refuse to take it, you refused, even if you offered to take a blood test instead.(FYI, the breath test favors the violator; they come out consistently lower than blood tests.)If I arrest you for DWI, get blood drawn, and no alcohol or drugs show up in the blood test, then you will probably get found not guilty in court. I have never had that happen to me. Every person I have arrested who has taken a test has tested positive for alcohol or drugs.
