Q: In its 2001 White Paper , Justice for all, the govermant promised to rebalance the criminal justice system in favour of its victims...Do you think this aim has been achieved and should this actually be the aim of the criminal justice system???
A: It's hard to say. It certainly does not feel like it, but is that merely media scaremongering or not? I think the criminal justice system is brilliant when it comes to serious crimes, but is failing badly when it comes to minor crimes and anti-social behaviour. The aim of the criminal justice system should be re-balanced in favour of victims rather than criminals. We all give up the freedom to dispense justice ourselves - 'natural justice' as Locke puts it - and place that power in the hands of the state to do it for us, otherwise we end up with the law of the jungle, but when the state fails to defend us, the criminals win.As long as yobs on the street feel free to flout the law, the criminal justice system is broken.
