Possible FERPA Violation?
Q: I am a first year student at a prestigious American university...Early in the school year, I was written up by my Residential Adviser for noise violations, having sex in another student's bed, and using a racial slur. I was called into the student conduct office to discuss this case, and I wrote my version of what happened under signed oath, promising that I was not drunk, but had been drinking, and my actions were not affected by my drinking. The report had been greatly over exaggerated, I did not have sex in another student's bed though I was with a girl in his room, and I was rapping along with some music with a group of buddies when my RA heard me say the "N" word...Anyways, I got a reprimand and my parents were not informed of the incident. However, later this year, I was caught smoking marijuana in the dorm, written up and then placed on probation with the school. They did inform my parents of this. Additionally, the dean of conduct read the previous reprimand report to my parents without my permission. According to the Family Educational Rights and Privacy Act (FERPA), post-secondary institutions are allowed to release information on alcohol and drug violations without my permission, however they are not allowed to discuss other disciplinary actions. The fact that they told my parents about the other things I was written up for has significantly damaged our relationship and they are considering pulling my tuition money. They also do not believe me when I tell them about the falsities in the report written by my RA. I am interested in pursuing legal action on the school since I feel my privacy rights have been violated. Can anyone with professional experience tell me what my position is here? Also, any lawyers in particular to contact about this case? Thank you very much(Informed responses regarding the legal case only please, I'm not asking for your opinion on my behavior or relationship with my parents)
