Fifth Amendment Rights regarding self incrimination in a criminal trial when called as a witness?
Q: As a witness for the defense I was asked to turn over evidence that was in my control and to testify to that evidence. I was later arrested for the evidence that I was coerced to turn over to the court, but I was never called to testify. The evidence would have exonerated the defendant, but the Prosecutor became upset and turned on me and charged me with a felony. The Prosecutor ignored the new evidence and proceeded and continued to prosecute the defendant. I was not reinbursed for my property by the State, who requested that property. I was told that I would not get in trouble, however that was a lie. According to what I read in the Fifth Amendment, it states that a person can not be called to testify , nor to give evidence in a criminal trial, that later will be used against them in different criminal trial. Nor can the state take any property from a citizen and not reinburse them for their property. Then I am wondering how can the State proceed against me, using the evidence, which is my testimony on media against me, and charge me, when the evidence was collected to be used in a criminal trial. The fact that I turned it over to them, shows that I did not have any criminal intent , or knowledge that I may have violated any law. I did not prosper nor conspire to defraud anyone, nor harm or injure anyone in what I did no plaintiff against me, other than the State and the Prosecutor who filed charges against me. The only one that got their feelings hurt was the Prosecutor and Police, who in turn have caused me a great inconvenience in this retalitory action against me. Your thoughts would be appreciated and welcome.
A: The 5th Amendment states you are not legally obligated to testify or provide evidence against yourself. You can't produce the evidence THEN argue your 5th amendment rights were violated when you voluntarily gave up the evidence.
