How can I have my clients electronically sign documents legally?
Q: Basically, I'm a new business in which I have clients all across the country (USA) and I'd like to streamline my agreement processing. I email them a document and I'd like them to sign it and be able to email it back to me. If I'd have them attach their DL number or last 4 of social on the agreement, and their full name, can that constitute as a signature? A lot of my clients don't have a lot of time to print out a document, sign it, and snail mail it back to me. A whole process which can takes a couple weeks for the agreement to get back to me.
A: Well that would not be considered as legal, I have done that and I faced consequences, but what you can do is to fax them those specific documents and ask them to after signing it, send you back, The main reason of not accepting it as legal since the chances of forgery and fakeness can be higher, by this you only end up increasing your "compliance risk", For further details ask your bank, if bank is willing to accept those then you are lucky fellow, however in my case banks didn't accept them
